CONTEST RULES AND REGULATIONS

THE CONTEST

These Rules and Regulations apply to the (TxT) What's NxT 4 Me Photo Contest. This Contest is sponsored by the Iowa Department of Human Services who hereafter shall be referred to as Contest Sponsor(s).

HOW TO PARTICIPATE IN THE (TxT) WHAT'S NxT 4 ME PHOTO CONTEST

You must have a Facebook profile and become a fan of the Talking Sex Together (TxT) page on Facebook. Visit the Talking Sex Together (TxT) Facebook page and upload a photo of what influences you to avoid becoming a teen parent. Name the photo a phrase, acronym, or euphemism. Describe, in 100 words or less, how the people, concepts, or things depicted in the photo influence you to not become a teen parent. Submissions must be uploaded to the Talking Sex Together (TxT) Facebook page between October 21, 2008 and February 13, 2009.

LIMITATION ON NUMBER OF SUBMISSIONS PERMITTED

Only three submissions per person may be submitted to the Contest. Only one prize will be provided to the winner. Submissions are subject to verification and will be declared invalid if they are reproduced, falsified, altered, or tampered with in any way. Furthermore, an individual may be disqualified from winning the prize in the event a said person is found to have violated the participation rules. Submissions using profanity, racial/ethnic slurs, slander, or hate will be deleted. All submissions must support the teen pregnancy prevention message to be included in the Contest. Submissions determined not to support the teen pregnancy prevention message will be deleted. All submissions will be reviewed by Contest promoters to determine validity. All decisions are final.

ELIGIBILITY

The Contest is open to 13-19 year olds residing within the state of Iowa, excluding employees, Contest Sponsor(s), directors, and officers for FutureNet, Fleishman-Hillard Inc. and supporting advertising and promotional agencies, as well as family members of any of the foregoing.

In order to make a submission, the participant must:
a) Be a resident of the state of Iowa
b) Be above the age of 13 and below the age of 19
c) Become a fan of the Talking Sex Together (TxT) Facebook page
d) Upload a photo to the Talking Sex Together (TxT) Facebook page of what influences her/him to avoid becoming a teen parent
e) Name the photo with a unique acronym that supports the teen pregnancy prevention message
f) Describe how the photo influences her/him to not become a teen parent in 100 words or less
g) Read the Contest terms and conditions, including Contest rules

The Contest Sponsor will verify that the Contest winner satisfies requirements A and B by contacting the winner's school, residence, or workplace. Each participant agrees:

• that he or she freely and voluntarily agrees and does hereby assume any and all risks of personal injury, illness, death arising out of or connected with his or her participation in the Contest and receipt/use of a prize; and
• that he or she releases FutureNet, Fleishman-Hillard Inc., and its Sponsor(s)hip affiliations, as well as their respective advertising and promotional agencies (collectively, the "Releasees") from any and all liability arising in connection with participation in the Contest and receipt/use of a prize, including, without limitation, any financial, legal or moral responsibility or loss or personal injury, including death or damage to or loss of property suffered or incurred or arising from participating in the Contest, whether suffered by the prize winner, or by his or her heirs, administrators, personal representatives, or executors, and notwithstanding that such injuries or losses may have been caused solely or partly by any act, omission, negligence, or gross negligence of any or all of the Releasees.
• All submissions shall become the property of FutureNet, the Sponsor(s), and their advertising, public relations, and promotional agencies. The Releasees assume no responsibility for lost, stolen, destroyed, or otherwise indecipherable submissions due to any failure or technical malfunction of the telephone network, computers, fax machines, on-line computer systems of equipment, servers, access providers, software, poor reception, technical problems, and failure of any e-mail or mobile submission, human error, or due to any other reason regardless of cause.
• That he or she has all necessary rights to upload his/her entry photo to Facebook for purposes of the contest and that no third party has rights, including but not limited to rights of publicity or ownership, in relation to said photo or its use in the Contest.

CONTEST FINALISTS

All photo submissions must be uploaded to the Talking Sex Together (TxT) Facebook page by February 13, 2009. The Contest promoters will review all entries and select the top six as finalists.

Finalists will be selected based on:
a) Originality of photo (30%)
b) Creativity of acronym/euphemism for name of photo (30%)
c) Appropriateness of photo description for teen pregnancy prevention theme (40%)

Finalists will be notified that they have been selected in the top six via a Facebook message.

VOTING

Beginning February 23, 2009, Facebook users may visit the Talking Sex Together (TxT) Facebook page to vote for the top six finalists/entries. Each person may vote an unlimited number of times. In order to vote, you must be a Facebook user but do not need to be a member of the Talking Sex Together (TxT) Facebook page. Voting will cease March 9, 2009.

GRAND PRIZES

Grand prizes will be awarded to the female individual and male individual that receive the most votes.

The grand prizes are $500.00 Visa gift cards for each of the two winning individuals. The approximate value of each Prize is $500.00.

The winning individuals will be notified via a Facebook message. The winners must claim the prizes within thirty (30) days of winning (the "Deadline"). If a winning individual fails either to claim the prize or inform FutureNet of her/his inability to claim the prize before the Deadline, the prize will be forfeited and awarded to a different individual. Two prizes will be awarded to two individuals.

In the case of a tie among female entrants or among male entrants, the voting will be extended for one week for the tied individuals. If after one week there is still a tie, the Contest promoters will select the winner.

The prize must be accepted as awarded. No portion of any prize is transferable. No substitute for any portion of any prize is offered. FutureNet, Fleishman-Hillard Inc., Contest Sponsor(s), and their respective advertising, public relations, and promotional agencies reserve the right to substitute any prize or any component thereof for those of approximately the same value, and reserve the right to change the Contest rules or terminate or withdraw the Contest at any time, without prior notice.

The winning individuals are responsible for all incidental expenses incurred in connection with accepting the prize (the "Expenses"). The winning individuals understand that he or she may not seek reimbursement for the Expenses from Contest Sponsor(s), FutureNet, Fleishman-Hillard Inc., or their respective advertising, public relations, and promotional agencies.

The chance of winning depends on the number participants.

COMPLIANCE WITH CONTEST RULES

All Contestants agree to abide by the Contest Rules, which are subject to change at the sole discretion of FutureNet, Fleishman-Hillard Inc., Contest Sponsor(s), Contest advertising agencies, public relations firms, and promotional agencies.

COMPLIANCE WITH LAWS

This contest is void where prohibited by law and is subject to the laws of Iowa and all federal provincial, territorial, and municipal laws and regulation of the United States.
