TxT will not collect personally identifiable information from you without your permission. TxT does not share your personal information or phone number with any third parties. All text communications will come directly from TxT, and all information gathered will be used for the sole purpose of fulfilling the mission of the TxT program.

SWEEPSTAKES RULES AND REGULATIONS

These Rules and Regulations apply to the (TxT) Mobile Sweepstakes. This Sweepstakes is sponsored by the Iowa Department of Human Services who hereafter shall be referred to as Sweepstakes Sponsor(s).

HOW TO PARTICIPATE IN THE (TxT) MOBILE SWEEPSTAKES

Participants must opt in to the (TxT) Mobile Sweepstakes in order to qualify for the monthly sweepstakes and grand Prize sweepstakes. Participants may opt in by texting a keyword phrase to short code 61399 on their mobile phone; by having another participant submit their phone number to the short code with their verbal or written permission; or, by submitting their cell phone number via the mobile program widget on Facebook, MySpace, or www.teenstxt.com. In all cases except the first, a double opt-in process is required, in which participants must respond "Yes" to the automatically generated text message from TxT. Participants must opt-in between November 1, 2009 and April 10, 2010 to be eligible for the sweepstakes. There is no charge to enter.

LIMITATION ON NUMBER OF SUBMISSIONS PERMITTED

Only one entrant per cell phone number may participate in the Sweepstakes. Only one submission may be made per sweepstakes opportunity from each cell phone. Only one Prize will be provided to each winner of the monthly and grand Prize sweepstakes. Submissions are subject to verification and will be declared invalid if they are reproduced, falsified, altered, or tampered with in any way. Furthermore, an individual may be disqualified from winning the Prize in the event a said person is found to have violated the participation rules. All submissions will be reviewed by Sweepstakes promoters to determine validity. All decisions are final.

ELIGIBILITY

The Sweepstakes is open to 13-19 year-olds residing within the state of Iowa, excluding employees, Sweepstakes Sponsor(s), directors, and officers for FutureNet, Fleishman-Hillard Inc. and supporting advertising and promotional agencies, as well as family members of any of the foregoing.

In order to enter the Sweepstakes, the participant must:
a) Be a resident of the state of Iowa
b) Be above the age of 13 and below the age of 20
c) Be the owner of a cell phone with an Iowa area code and text messaging capability
d) Opt-in to participate in the Sweepstakes
e) Continue SMS subscription until April 30, 2010
f) Read the Terms and Conditions, Sweepstakes Rules and Regulations, and Privacy Policy

Each participant agrees:

• That he or she freely and voluntarily agrees and does hereby assume any and all risks of personal injury, illness, death arising out of or connected with his or her participation in the Sweepstakes and receipt/use of a Prize; and
• That he or she releases FutureNet, Fleishman-Hillard Inc., and the Sweepstakes Sponsor as well as their respective advertising and promotional agencies (collectively, the "Releasees") from any and all liability arising in connection with participation in the Sweepstakes and receipt/use of a Prize, including, without limitation, any financial, legal or moral responsibility or loss or personal injury, including death or damage to or loss of property suffered or incurred or arising from participating in the Sweepstakes, whether suffered by the Prize winner, or by his or her heirs, administrators, personal representatives, or executors, and notwithstanding that such injuries or losses may have been caused solely or partly by any act, omission, negligence, or gross negligence of any or all of the Releasees.
• All submissions shall become the property of FutureNet, the Sweepstakes Sponsor(s), and their advertising, public relations, and promotional agencies. The Releasees assume no responsibility for lost, stolen, destroyed, or otherwise indecipherable submissions due to any failure or technical malfunction of the telephone network, computers, fax machines, on-line computer systems of equipment, servers, access providers, software, poor reception, technical problems, and failure of any e-mail or mobile submission, human error, or due to any other reason regardless of cause.
• That he or she has all necessary rights to submit his/her cell phone number to the Sweepstakes Sponsor for purposes of the Sweepstakes and that no third party has rights, including but not limited to rights of publicity or ownership, in relation to said cell phone number or its use in the Sweepstakes.

MONTHLY AND GRAND PRIZES

Monthly Prizes will be awarded to a participant once per month for six months, beginning in November 2009 and ending in April 2010. To be eligible for the sweepstakes, the winner must respond to the sweepstakes question received via text and, if applicable, provide the correct answer. If the question is open-ended, any response will suffice, as long as the response is relevant to the question and includes no profanity, racial/ethnic slurs, slander, or hate. Participants must respond to the question within the designated time period, as indicated in the texted contest question, to be eligible for the Prize. One Prizewinner will be randomly selected each month from the pool of respondents who meet the aforementioned eligibility criteria. The monthly Prize consists of one $25.00 Visa gift card. The approximate value of each Prize is $25.00. After a participant has won a monthly Prize, she/he is no longer eligible to win additional monthly Prizes for the duration of the program but continues to be eligible to win the grand Prize. Monthly Prizes will be awarded within one month of notifying the winner.

One grand Prize will be awarded to a randomly selected participant. The grand Prize is one $500.00 Visa gift card. The approximate value of the Prize is $500.00. The grand Prize will be awarded in May 2010.

Winning individuals will be notified via text message. Winners must claim Prizes within thirty (30) days of winning (the "Deadline"). If a winning individual fails either to claim the Prize or inform FutureNet of her/his inability to claim the Prize before the Deadline, the Prize will be forfeited and awarded to a different individual.

Prizes must be accepted as awarded. No portion of any Prize is transferable. No substitute for any portion of any Prize is offered. FutureNet, Fleishman-Hillard Inc., Sweepstakes Sponsor(s), and their respective advertising, public relations, and promotional agencies reserve the right to substitute any Prize or any component thereof for those of approximately the same value, and reserve the right to change the Sweepstakes rules or terminate or withdraw the Sweepstakes at any time, without prior notice.

inning individuals are responsible for all incidental expenses incurred in connection with accepting the Prize (the "Expenses"). The winning individuals understand that he or she may not seek reimbursement for the Expenses from Sweepstakes Sponsor(s), FutureNet, Fleishman-Hillard Inc., or their respective advertising, public relations, and promotional agencies.

The chance of winning depends on the number participants.

COMPLIANCE WITH LAWS

This Sweepstakes is void where prohibited by law and is subject to the laws of Iowa and all federal provincial, territorial, and municipal laws and regulation of the United States.
